What does a Trial Attorney Do?
Develop Trial Strategy
The Trial Attorney evaluates the facts and applicable law to develop a persuasive litigation and trial strategy aligned with the client’s objectives.
Prepare Cases for Trial
Manages discovery, depositions, legal research, witness preparation, exhibits, motions, and other activities required to prepare a case for trial.
Handle Motion Practice
Drafts and argues motions, briefs, and other legal filings designed to establish or protect the client’s position throughout litigation.
Present Courtroom Arguments
Furthermore, presents opening and closing arguments, examines witnesses, introduces evidence, and advocates for clients during trial proceedings.
Negotiate Resolutions
Represents clients in settlement negotiations, mediation, and other dispute-resolution processes when a negotiated outcome is appropriate.

KEY RESPONSIBILITIES
- Represent clients in commercial litigation matters and develop comprehensive litigation and trial strategies.
- Conduct legal research and prepare pleadings, motions, briefs, discovery materials, trial exhibits, and other legal documents.
- Manage depositions, witness preparation, hearings, settlement discussions, and other pretrial activities.
- Present legal arguments, examine witnesses, and advocate for clients during trials and other court proceedings.
- Communicate with clients, opposing counsel, witnesses, experts, courts, and legal teams throughout the litigation process.
QUALIFICATIONS & REQUIREMENTS
Experience
5-15+ years of experience in trial practice, commercial litigation, civil litigation, or a related practice area, depending on the seniority of the position.
Education
Juris Doctor (J.D.) degree from an accredited law school.
Certifications
Active admission to the applicable state bar and eligibility to practice before relevant state and federal courts as required by the position.
